This Rental Agreement (“Agreement”) is made between PDX Dumpster (“Owner”) and the undersigned renter (“Renter”).

1. Rental Period:

The rental period begins on the date of delivery and ends on the actual pickup date.

2. Rental Fee:

Renter agrees to pay the initial rental fee specified at the time of booking plus solid waste disposal fees at actual cost ("Waste Fees"). Payment for the dumpster rental is due prior to delivery (“Deposit”) and a subsequent payment is required for all Waste Fees.

3. Delivery and Placement:

Dumpsters will be placed at approved private property locations provided at time of

booking. Renter agrees to place the dumpster on a solid, stable, and level surface, such as concrete, asphalt, compacted gravel, or another suitable material capable of supporting the dumpster's weight. Owner is not responsible for any damage to driveways, sidewalks, curbs, lawns, or other surfaces resulting from the placement, use, or removal of the dumpster.

By accepting delivery, Renter assumes full responsibility for any damage to the placement area and surrounding property, including but not limited to cracks, ruts, indentations, or other marks caused by the dumpster, delivery vehicle, or related equipment. Renter is encouraged to take necessary precautions, such as placing plywood or protective materials under the dumpster, to minimize potential damage.

Owner reserves the right to refuse placement on surfaces deemed unsafe or unsuitable. If an alternate placement location is required, additional fees may apply.

4. Liability Waiver:

Renter agrees that Owner is not liable for any damages to the property or surrounding areas during the rental period. Owner is not liable for any damage to property resulting from the delivery, placement, or removal of the dumpster. Renter assumes full responsibility for any damage caused by the dumpster, including but not limited to ground damage, driveway damage, or any other property damage.

5. Damage to Dumpster or Theft:

Renter may not fill the dumpster with more than 3 tons (or 6,000 lbs) of waste. Renter is liable for any damages to the dumpster during the rental period, including but not limited to punctures or excessive wear. Renter agrees to pay for repair or replacement costs at no less than $250 if the dumpster is returned in damaged condition. If the dumpster is damaged beyond working repair or stolen from the Renter’s private property, the full replacement cost of $7,000 for the dumpster shall be assumed by the Renter.

6. Acceptable Use:

Renter shall not place hazardous materials into the dumpster, including but not limited to, batteries, paints (oil, aerosol or water based), fuels and oils, household chemicals (cleaners, bleach, sanitizers and detergents), refrigerators and freezers, flat roof, hot water tanks, medical waste, railroad ties, poison, insecticides, pesticides, herbicides, fluorescent bulbs, asbestos, propane tanks, tires; and no more than 1 yard of dirt, rock, concrete or plaster. 7. Building Materials:

Any building materials must have an asbestos abatement test done prior to dumpster pickup and Renter shall provide such paperwork to Owner upon dumpster pickup. If no asbestos testing paperwork is supplied, waste fees may exceed $3,000.

Analytical test results certifying all tested sample results contain 1 percent or less asbestos by weight are required for the following items:

• Interior walls and ceilings: acoustical tiles, glue dots, plaster, and textured surfaces

• Exterior walls: cement siding, stucco

• Flooring: vinyl tiles, sheet vinyl, some mastic adhesives

• Insulation/fireproofing: block, boiler, spray-applied, vermiculite, monokote, sink undercoating, thermal system insulation (fiberglass, cellulose, and mineral wool are exempt)

• Gaskets: furnace, mechanical, boiler, wood stove (automotive gaskets are exempt)

• Heating: white paper or seam tape on ducts, air-duct cement and insulation

• Roofing materials: tar paper, felt, silver/white roofing paint, Nicolite paper

• Fire doors, fire/kiln brick and fireproofing

• Various compounds: window glazing, adhesives, caulks, patching, mastics, vapor barrier products (plastic or synthetic materials such as Tyvek are exempt)

• Electrical: switch gear, circuit boxes and fuse panels; wiring with cloth insulation

(Romex wiring is exempt)

8. Indemnification:

Renter agrees to indemnify and hold Owner harmless from any claims, damages, or losses arising from the use of the dumpster during the rental period.

9. Warranties:

By signing this Agreement, Renter represents and warrants that a) Renter has full authority to place dumpster on the property address provided to Owner at time of booking and b) Renter has fully complied with the obligations under this Agreement.

10. Governing Law:

This Agreement shall be governed by the laws of the State of Oregon.

11. Additional Provisions:

Any modifications to this Agreement must be made in writing and signed by both parties. This Agreement constitutes the entire understanding between the parties.

This Agreement will be considered accepted by Renter upon Renter’s payment of the Deposit.
